1. Acceptance of Terms

By accessing or using LumeSwap ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. LumeSwap reserves the right to modify these terms at any time, and your continued use of the Platform constitutes acceptance of any modifications.

2. Description of Services

LumeSwap provides the following services on the Solana blockchain:

Decentralized token swap functionality
AI-powered token security analysis (LumeAI Score)
Copy trading services allowing users to follow trader strategies
Portfolio tracking and analytics

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. By using LumeSwap, you represent and warrant that you meet these requirements and that your use of the Platform does not violate any applicable laws or regulations in your jurisdiction.

4. Wallet Connection and Custody

Swaps are non-custodial. When you connect your own wallet to trade, we never have access to its private key or seed phrase. Every transaction is signed by you, and we cannot move those funds.

Copy trading and Earn are not. Copy trading requires a dedicated wallet that the Platform generates for you and that you fund by deposit. Its private key and seed phrase are stored by the Platform in encrypted form and are used to sign copied trades on your behalf. You may reveal the seed phrase at any time by signing a message with your connected wallet, and withdrawals are sent only to that wallet. Earn deposits are sent to a Platform-controlled address and withdrawals are processed on request. For these features the Platform holds keys that control your deposited funds, and you should treat them as custodial.

You are solely responsible for maintaining the security of your connected wallet and any transactions initiated through the Platform. We recommend using hardware wallets for enhanced security, and depositing into copy trading or Earn only what you can afford to lose.

5. Risk Disclosure

Trading cryptocurrencies involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results.

By using LumeSwap, you acknowledge and accept the following risks:

Cryptocurrency prices are highly volatile and can result in significant losses
Smart contract risks, including potential bugs or vulnerabilities
Liquidity risks that may affect your ability to execute trades
Regulatory risks as cryptocurrency regulations continue to evolve
Copy trading does not guarantee profits; past performance of traders is not indicative of future results
LumeAI Score is an analytical tool and does not guarantee token safety

6. Copy Trading Terms

When using copy trading features:

You authorize the Platform to execute trades on your behalf based on the selected trader's actions
Commission fees (up to 20%) may be charged on profits generated through copy trading
You can stop copying a trader at any time
Minimum and maximum investment limits may apply
The Platform is not responsible for losses incurred through copy trading

7. Fees

LumeSwap may charge fees for certain services. All applicable fees will be clearly displayed before you confirm any transaction. Network fees (gas fees) are paid directly to the Solana network and are not controlled by LumeSwap.

8. Prohibited Activities

You agree not to:

Use the Platform for any illegal purposes
Attempt to manipulate markets or engage in wash trading
Use bots or automated systems to gain unfair advantages
Interfere with the Platform's operation or security
Impersonate other users or traders
Circumvent any access restrictions or security measures

9. Limitation of Liability

To the maximum extent permitted by law, LumeSwap and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless LumeSwap, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration.
